The allocation of Heybeliada Sanatorium in Istanbul to the Presidency of Religious Affairs was canceled as a result of the lawsuit.
As a result of the joint lawsuit filed by the Istanbul Medical Chamber (ITO), TMMOB Chamber of City Planners Istanbul Branch, TMMOB Chamber of Architects Istanbul Metropolitan Branch, Istanbul Bar Association and the Turkish Thoracic Society, the allocation of Heybeliada Sanatorium in Istanbul to the Directorate of Religious Affairs was annulled.
In September 2020, it was revealed that the land, including the Heybeliada Sanatorium building, was allocated to the Presidency of Religious Affairs. Many institutions filed a lawsuit for the annulment of this allocation process, stating that it was “in the public interest and against the law”.
In the lawsuit filed; It was requested that the execution and cancellation of the process regarding the allocation of the real estate, which includes the Heybeliada Sanatorium building, in Istanbul Province, Adalar District, Heybeliada Mahallesi, plot 3, block 105 and parcel number 1, to the Presidency of Religious Affairs, to be used as a training center, which is owned by the Treasury, was requested.
According to the news of İsmail Arı from BirGün, The 14th Administrative Court of Istanbul also decided to cancel the allocation on 14 June. The following statements were included in the unanimous decision of the court:
“…With the interim decisions of our court dated 22.04.2021 and 08.07.2021, the defendant administration announced that ‘the immovable in dispute was removed from the Ministry of Health, and the Ministry of Culture and Tourism was informed before the process regarding the allocation of it to the Presidency of Religious Affairs to be used as a training center was established. It is requested that an approved and legible copy of all relevant information and documents be sent by asking whether an opinion has been taken, and if an opinion has been given by the Ministry of Culture and Tourism, which is submitted to the case file as per the interim decision of the defendant administration, dated 05.08.2021 and E. -As it is understood in the letter of the Directorate of National Real Estate of the Anatolian Side No.-1434289 that ‘the information or document about whether the opinion of the Ministry of Culture and Tourism was received before the allocation process in question could not be found in the administration file’, therefore, it was understood that no permission or opinion was obtained from the relevant Ministry before the allocation process, which is the subject of the case. obtaining permission from the relevant Ministry It has been concluded that there is no lawfulness in the action that is the subject of the lawsuit regarding the allocation of the said real estate to the Presidency of Religious Affairs to be used as a training center.”
In the statement made by the Istanbul Medical Chamber, it was said, “We will continue to fight for the refunctioning of the Heybeliada Sanatorium building for health purposes and to use it in accordance with the public interest.”
